Terms of Use
The terms for using TermBook, the score-sheet, results and class-register app for teachers and schools by Novaxion Systems LTD.
In short: TermBook works out scores and results from what you enter; the school checks and approves them before they are published. Each school gets one free term, then buys a plan through Google Play. A school owns its records and can always view and export them, even after its plan ends.
1. About these terms
These Terms of Use are an agreement between you and Novaxion Systems LTD (“Novaxion”, “we”, “us”), registered in Nigeria (RC number to be inserted). They cover your use of the TermBook app and service.
By creating an account or using TermBook, you agree to these terms and to the TermBook Privacy Notice. If you set up TermBook for a school, you accept these terms on the school’s behalf and confirm you are authorised to do so.
2. Your account
- Give your real name and an email address you control; you confirm it with a code.
- Keep your password private. You are responsible for what is done with your account.
- Tell us at once if you think someone else is using your account.
- You can use TermBook in Personal mode without an account; your records then stay on your phone.
3. Schools and roles
- The person who registers a school is its first admin. Admins invite staff by email and give them roles: class teacher, subject teacher, deputy or admin.
- The school is responsible for having the right to record its pupils’ data, for whom it gives access to, and for removing staff who leave.
- A person can belong to at most three schools at a time.
4. Scores and results
- TermBook calculates totals, averages, grades and positions from the scores and settings entered. Correct results depend on correct scores and settings.
- The school must check results before it approves and publishes them. Approved results are locked; changing one needs an admin to unlock it with a reason, and every version is kept.
- Report sheets and other documents produced with TermBook are the school’s documents.
5. Fair use
You agree not to:
- enter scores or registers you are not responsible for, or falsify them;
- use fake-location apps or other tricks to make a register look as if it was taken at school;
- open new schools or accounts to get more than one free term;
- try to reach data your role does not give you, or disrupt the service;
- copy, resell or reverse-engineer the app.
6. Free term, plans and payment
- Free term: a new school gets one free term (4 months) for up to 150 students, with every school feature. A free term is linked to the people in it: someone who has already been part of a free term, as admin or staff, does not get another one for a new school. If you think a free term was refused by mistake, contact us.
- Paid plans: school plans and Personal Pro are subscriptions sold only through Google Play inside the app, and only a school admin can buy a school plan. Prices shown in the app come from Google Play. Google Play’s terms apply to payment, renewal, cancellation and refunds.
- Renewal: subscriptions renew automatically until cancelled in Google Play.
- Student limits: each school plan allows a number of students, with a small margin. Above it, new students can’t be added until the school moves to a bigger plan; existing students’ records always keep working.
- When a plan ends: after any grace period the school becomes read-only. Its records stay viewable, printable and exportable. We never delete a school’s records without notice.
7. Data and privacy
A school owns the records it keeps in TermBook. We handle personal data as described in the TermBook Privacy Notice. Personal-mode records stay on your phone; keep backups, because we can’t restore records we never received.
8. The service
- TermBook works offline; changes sync when there is a connection. Work not yet synced lives only on that phone until it is sent.
- We may pause syncing for maintenance; your work stays on your phone meanwhile. We may ask you to update an old version of the app before it can sync.
- We improve TermBook over time and may change or remove features, with notice for important changes.
9. Ending or suspending use
- You can stop using TermBook at any time and delete your account in the app (Settings → Delete my account) or at novaxion.ng/accounts.
- We may suspend or end access for serious or repeated breaches of these terms, after a warning where possible. A school’s records stay exportable unless the law requires otherwise.
10. Responsibility and limits
To the extent the law allows, TermBook is provided “as is”, without a promise that it will be uninterrupted or error-free.
To the extent the law allows, Novaxion is not liable for indirect or consequential losses, or for the results of decisions based on records the school entered and approved.
Our total liability for any claim is limited to the amount paid for TermBook in the 12 months before the claim. Nothing in these terms limits liability the law does not allow us to limit.
11. Governing law and disputes
These terms are governed by the laws of the Federal Republic of Nigeria.
If something goes wrong, please contact us first. Any dispute not resolved within 30 days may be taken to the courts of Nigeria.
12. Changes to these terms
We may update these terms. We will change the “Effective date” above and, for significant changes, tell you in the app or by email before they take effect. If you keep using TermBook after a change takes effect, you accept the updated terms.
